Bankruptcy

Many of our clients come to us after several sleepless nights, exhausted from the mental and emotional strain financial troubles bring. Sometimes getting out of your mortgage or modifying your loan and settling your unsecured debt just isn’t enough. In times like these, bankruptcy is not only a viable option, but also turns out to be the best resolution to your financial strains.

Bankruptcy does not have the stigma attached to it as it did years ago. The number of bankruptcies filed in 2009 is projected to double from the number filed in 2008. Bankruptcy laws were significantly changed in 2005 and made discharging certain debts much more difficult. However, due to the recent credit and housing crises, the legislature is re-examining the bankruptcy laws and making necessary changes to help consumers in bankruptcy. Some of the proposed changes include mortgage cram downs or lien stripping second liens all together. The new administration has even considered allowing student loan debt to be dischargeable in bankruptcy.

Bankruptcy laws are constantly evolving and it’s nearly impossible to keep abreast of all the changes without devoting all day, every day to it. That’s where we come in. Our attorneys deal with bankruptcies every day and devote countless hours every week to stay on top of proposed changes in the law. We even have a paralegal devoted specifically to our bankruptcy practice. Since we know our clients are losing sleep over their financial struggles, we offer evening and weekend hours in addition to our free ½ hour consultations.
